for online ticket purchase

SUBJECT MATTER OF THESE TERMS AND CONDITIONS
These General Terms and Conditions (hereinafter referred to as "Terms and Conditions") govern the legal relationship between visitors to the Kurzfilm Festival Hamburg and the Mo&Friese - Junges Kurzfilm Festival Hamburg (hereinafter referred to as "you") and the Kurzfilm Agentur Hamburg e.V. Bodenstedtstr. 16, 22765 Hamburg (hereinafter referred to as "Kurzfilm Agentur Hamburg"), which is the organizer of the Kurzfilm Festival Hamburg and the Mo&Friese Junges Kurzfilm Festival Hamburg.

• Contract between you and the Kurzfilm Agentur Hamburg concerning your visit to the event
When you purchase tickets online or at a daytime/evening box office, you enter into a contract with Kurzfilm Agentur Hamburg regarding your visit to the event. No contract for event attendance is concluded between you and the box office operator, as they only arrange ticket sales on behalf of and for the account of the Kurzfilm Agentur Hamburg.

PROGRAM, CHANGES, RELOCATIONS AND CANCELLATIONS OF EVENTS
Information about the program and events (cinema, season) can be found on the website as well as in the public announcements of the Short Film Festival Hamburg and the Mo&Friese - Junges Kurzfilm Festival Hamburg.
The Short Film Agency Hamburg is entitled to change the starting times or the theater at any time. In case of unforeseeable events, especially force majeure, the Kurzfilm Agentur Hamburg reserves the right to change the program as well as to postpone or cancel events.
All tickets remain valid in the event of a change or postponement.
If you are unable or unwilling to attend an event due to the changed performance time (date/start time) or a program change, the Kurzfilm Agentur Hamburg will refund the ticket price.

TICKET PURCHASE
• Ticket purchase at day/evening box offices
Tickets can be purchased from 16.05.2022 at the box office of the main festival cinema Zeise Kino. Starting 5/31, tickets will be available at the box offices of all festival cinemas (Zeise Kino, Lichtmess, 3001, Metropolis, B-Movie, Abaton) starting 30 minutes before the first screening. In the film room, tickets are only available for the events there. Tickets are on sale during the regular opening hours of the aforementioned ticket agencies.

• Online ticket purchase
Tickets can also be purchased online from 16.05.2022 via the festival websites festival.shortfilm.com and moundfriese.de. The ticketing system used is called topticketing 1.1.

• Purchase of discounted tickets
Discounted tickets are sold to persons who personally feel entitled to purchase discounted tickets. No credentials need to be presented.

• No right of revocation or return
Pursuant to Section 312g (2) Sentence 1 No. 9 of the German Civil Code (BGB), there is no right of withdrawal for consumers in the case of contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of the services. This is the case with cinema screenings. Therefore, please note that there is no right of withdrawal when purchasing tickets.

• No exchange of tickets
An exchange of tickets is excluded.

• No resale of tickets
You may purchase and use tickets for private purposes only. You are not allowed to purchase tickets for commercial resale, i.e. resale for profit. With this regulation, the Kurzfilm Agentur Hamburg wants to ensure that tickets can be purchased by as many visitors as possible at the prices set by the festival.

In the event of commercial resale, the Kurzfilm Agentur Hamburg is entitled to block the tickets in question. Holders of commercially resold tickets are not entitled to admission to or attendance at the event in question.

EVENT VISIT
• Admission / No admission after the start of the performance
Admission to an event is only possible with a valid ticket. Unless otherwise agreed with Kurzfilm Agentur Hamburg in text form, the sole presentation of an order confirmation or invoice does not entitle the holder to admission or event attendance.
There is no entitlement to admission after the start of the performance. In this case, the ticket in question is no longer valid.

• Hygiene measures
The current hygiene measures for the containment of the Corona virus are posted at the respective locations and must be observed.

• Hygiene concept of the respective cinema
Furthermore, the respective hygiene concepts of the cinemas on site must be observed. This applies in particular to any adapted routing, signage, use of sanitary areas or elevators. The individual hygiene concepts of the cinemas can be viewed on the respective website of the cinemas.

• Exclusion in the event of non-compliance with hygiene measures
Persons who do not follow or refuse to follow the hygiene guidelines are to be excluded from participation in the event or are to be refused entry to the event.

• Possession of the ticket during the event
You must be in possession of a valid ticket for the entire duration of your visit to the event. Violations of this obligation may constitute a criminal offense and trigger claims for damages by the film distribution companies.

• Admission of children and young people to events
For the protection of children, persons under the age of three are not permitted to attend cinema screenings. Children up to the age of ten may only be admitted if accompanied by an accompanying person. The accompanying person is obliged to supervise the child at all times.
Children and adolescents are only admitted to film screenings that have been approved for their respective age by the Voluntary Self-Regulation Body for the Film Industry (Freiwillige Selbstkontrolle der Filmwirtschaft, FSK) and that end at specific times. It is not permitted to take children to films with an unsuitable FSK rating. The age ratings for the films of the Mo&Friese - junges Kurzfilm Festival Hamburg are published on the Mo&Friese Festival website.
Admission to the screenings of the Short Film Festival Hamburg is only permitted for persons 18 years of age and older.
If there is any doubt about the age, the Short Film Agency Hamburg or the respective cinema is entitled and obliged to check the age. In the event of a lack of legitimation, the child or young person will be excluded from admission to the event in question.

• Behavior in the cinema and during the events
It is not permitted to bring food and drinks into the cinema. Bringing bulky or dangerous objects, pyrotechnic objects, weapons, dangerous tools, spray cans, noise instruments, laser pens, bottles, cans, intoxicants and animals - with the exception of those required for assistance in case of physical or mental disability - is not permitted.
Smoking is prohibited in all festival cinemas. Cell phones may not be used in the cinema hall during the performance and must be turned on silent.

• Prohibition to make recordings
With the exception of cell phones, the taking of picture, film and sound recording devices is not permitted. It is also not permitted to make sound, image, or film recordings of the film screenings or the cinemas/event rooms, or to transmit or distribute such recordings in whole or in part via the Internet, social networks, or other media (including mobile telephony), or to assist other persons in such activities. Violators will be prosecuted under civil and criminal law.

• House rules / security measures (controls)
In the interest of security and the orderly and smooth running of an event, you are obliged to follow the instructions of the staff of the Kurzfilm Agentur Hamburg or the staff of the respective cinema.

• Refusal of admission / termination of event attendance
The Kurzfilm Agentur Hamburg and/or the respective cinema operator have the right to refuse you admission or visit to the event location - even after you have already been admitted.

• Processing of personal data
If personal data of you are processed, you are a data subject within the meaning of the GDPR and you have rights against the controller. You may request confirmation from the controller as to whether and which personal data concerning you are being processed (including, among other things, the purposes for which the personal data are processed; categories of personal data; recipients; storage period). In addition, you may, under certain conditions, request the correction or deletion of your data. You may furthermore have a right to restrict the processing of your data as well as a right to have the data you have provided handed over to you in a structured, common and machine-readable format. You have the right to lodge a complaint with a supervisory authority.
